{"id":111172,"date":"2021-06-24T19:28:14","date_gmt":"2021-06-24T18:28:14","guid":{"rendered":"https:\/\/www.musicbusinessworldwide.com\/?p=111172"},"modified":"2021-06-24T19:59:04","modified_gmt":"2021-06-24T18:59:04","slug":"uk-live-music-industry-sues-british-government","status":"publish","type":"post","link":"https:\/\/www.musicbusinessworldwide.com\/uk-live-music-industry-sues-british-government\/","title":{"rendered":"UK live music industry sues British government"},"content":{"rendered":"<p>The live music industry in the UK is suing the British Government.<\/p>\n<p>Legal action was launched today (June 24) to force the publication of a report from Phase 1 of the Government&#8217;s Events Research Programme (ERP).<\/p>\n<p>The <a target=\"_blank\" href=\"https:\/\/www.gov.uk\/government\/publications\/guidance-about-the-events-research-programme-erp-paving-the-way-for-larger-audiences-to-attend-sport-theatre-and-gigs-safely-this-summer\/guidance-on-the-events-research-programme\">purpose of the ERP<\/a> is to study &#8220;the risk of transmission of Covid-19&#8221; from attending sports and entertainment events, and business conferences.<\/p>\n<p class=\"p2\">      <div class=\"mb-advert__incontent\">      <div class=\"mb-advert mb-advert__tweeny hidden-xs hidden-ms hidden-sm\" data-loaded=\"no\" data-sizes=\"992 1200 1440\" data-name=\"628x90 Sponsor banner #5 (992+1200+1440)\" data-params=\"dfp_sponsor5_628\" id=\"dfp_sponsor5_628\"><\/div>      <div class=\"mb-advert mb-advert__banner mb-advert__banner--inline hidden-xs hidden-sm hidden-md hidden-lg\" data-loaded=\"no\" data-sizes=\"480\" data-name=\"468x60 Sponsor banner #5 (480)\" data-params=\"dfp_sponsor5_468\" id=\"dfp_sponsor5_468\"><\/div>      <div class=\"mb-advert mb-advert__mobile mb-advert__mobile--inline hidden-ms hidden-md hidden-lg\" data-loaded=\"no\" data-sizes=\"320 768\" data-name=\"300x50 Sponsor banner #5 (320+768)\" data-params=\"dfp_sponsor5_300\" id=\"dfp_sponsor5_300\"><\/div>      <\/div>      <\/p>\n<p>The live entertainment sector in the country has spent the last few months participating in full capacity pilot events as part of the ERP \u2013 including The BRIT Awards at The O2 arena, an outdoor festival event in Liverpool for 5,000 people and the Download festival, for 10,000 people last weekend.<\/p>\n<p>Today, live music industry body LIVE and a range of theater businesses, including Andrew Lloyd Webber\u2019s Really Useful Group, and theater producers Cameron Mackintosh, Michael Harrison and Sonia Friedman, have commenced legal proceedings against the Government to force it to hand over the research data.<\/p>\n<p class=\"p2\">      <div class=\"mb-advert__incontent\">      <div class=\"mb-advert mb-advert__spu\" data-loaded=\"no\" data-name=\"300x250 Sponsor MPU #1\" data-params=\"dfp_spu1\" id=\"dfp_spu1\"><\/div>      <\/div>      <\/p>\n<p>The pilot events have been &#8220;a huge success&#8221; according to the representatives taking legal action, who state that the government has confirmed this itself in various press reports, &#8220;showing that with proper precautions in place, live events at full capacity can go ahead safely&#8221;.<\/p>\n<p>In spite of the success of these events, the groups suing the Government argue that it has chosen &#8220;to keep the live entertainment industry under severe restrictions from June 21, while allowing parts of the economy that have not been subject to similar scientific studies,\u00a0 including hospitality, public transport and retail, to operate&#8221;.<\/p>\n<p>Earlier this month, the British government <a href=\"https:\/\/www.washingtonpost.com\/world\/2021\/06\/14\/britain-boris-johnson-coronavirus-freedom-day\/\" target=\"_blank\" rel=\"noopener\">announced a four-week delay<\/a> to the end of the country&#8217;s Covid restrictions, originally planned to be lifted on June 21, which would have allowed large scale events to take place legally from that date onwards.<\/p>\n<p><span style=\"font-weight: 400\">Those launching the legal action cite industry research that indicates the four-week delay to reopening will lead to around 5,000 live music gigs being cancelled as well as<\/span><span style=\"font-weight: 400\"> numerous theater productions across the country, costing hundreds of millions of pounds in lost income.<\/span><\/p>\n<p><span style=\"font-weight: 400\"> This impact was &#8220;well-known to the Government&#8221;, states the live industry, according to<a href=\"https:\/\/accessaa.co.uk\/events-research-programme-data-leak-indicates-huge-impact-of-prolonged-closure\/#:~:text=A%20leaked%20internal%20economic%20impact,in%20place%20beyond%2019%20July.&amp;text=Medium%20interventions%20include%20masks%20worn,and%20a%20ban%20on%20alcohol.\" target=\"_blank\" rel=\"noopener\"> leaked ERP economic impact\u00a0 assessments<\/a>. <\/span><\/p>\n<p>&#8220;As well as declining to publish the ERP results, the Government is yet to provide any form of\u00a0 insurance scheme for the sector or to make it clear what kind of ongoing mitigations may be\u00a0 required in the future \u2013 effectively making it impossible to plan for any live entertainment business,&#8221; stated the live industry and theatre businesses in a media release today.<\/p>\n<p><span style=\"font-weight: 400\">The live music industry and theater businesses also argue that the British Government has &#8220;flagrantly breached the \u2018duty of candour\u2019 which requires it to be transparent when faced with a legal challenge&#8221;.<\/span><\/p>\n<p><span style=\"font-weight: 400\">They also claim that &#8220;none of the reasons given for withholding the Events Research Programme material they seek\u00a0 withstand scrutiny&#8221;.<\/span><\/p>\n<p><span style=\"font-weight: 400\"> They have asked the Court to consider their application at an urgent hearing as\u00a0 soon as possible.<\/span><\/p>\n<hr \/>\n<p><span style=\"font-weight: 400\">Launched in March 2021, LIVE is an umbrella body for music industry associations representing 3,150\u00a0 businesses, over 4,000 artists and 2,000 backstage workers. <\/span><\/p>\n<p><span style=\"font-weight: 400\">LIVE&#8217;s members include the Association of Independent Festivals (AIF), Association for Electronic Music (AFEM), Association of\u00a0 Festival Organisers (AFO), Association of Independent Promoters (AIP), British Association of\u00a0 Concert Halls (BACH), Concert Promoters Association (CPA), Featured Artist Coalition (FAC),\u00a0 The Entertainment Agents\u2019 Association (TEAA), Music Venue Trust (MVT), Music Managers\u00a0 Forum (MMF), National Arenas Association (NAA), Production Services Association (PSA) and Society of Ticket Agents and Retailers (STAR). <\/span><\/p>\n<blockquote><p>\u201cThe Government&#8217;s actions are forcing theater and music companies off a cliff as the summer wears\u00a0 on, whilst cherry-picking high-profile sporting events to go ahead. We\u00a0 simply must now see the data that is being used to strangle our industry so unfairly.<\/p>\n<p>\u201cThe Government&#8217;s actions are forcing theater and music companies off a cliff as the summer wears\u00a0 on, whilst cherry-picking high-profile sporting events to go ahead. The situation is beyond urgent.\u201d<\/p>\n<blockquote><p>&#8220;It is intolerable that after running pilot shows for the Government\u2019s Events Research Programme, at our own cost, we have been blocked\u00a0 from seeing the results, leaving the whole sector in limbo with the real chance that the entire\u00a0 summer could collapse for the second year running.&#8221;<\/p>\n<p><span style=\"color: #000000\">Stuart Galbraith, LIVE<\/span><\/p><\/blockquote>\n<p>Stuart Galbraith, music promoter and Co-Founder of LIVE, the representative body for the live\u00a0 music industry, said: \u201cThe live music industry has been very willing to work with Government for the\u00a0 last year to show that our industry can operate safely.<\/p>\n<p>&#8220;But it is intolerable that after running pilot shows for the Government\u2019s Events Research Programme, at our own cost, we have been blocked\u00a0 from seeing the results, leaving the whole sector in limbo with the real chance that the entire\u00a0 summer could collapse for the second year running.<\/p>\n<p>\u201cEven now, the live music sector has no idea what the rest of the summer brings, and we are left\u00a0 with a complete inability to plan ahead due to the Government\u2019s continued unwillingness to provide\u00a0 some form of insurance to enable events to move forward.\u201d<\/p>\n<blockquote><p>\u201cWithout immediate government intervention, the festival industry is on the brink of collapse.&#8221;<\/p>\n<p><span style=\"color: #000000\">Peter Gabriel, WOMAD Festival<\/span><\/p><\/blockquote>\n<p>Peter Gabriel, WOMAD Festival, said: \u201cWithout immediate government intervention, the festival\u00a0 industry is on the brink of collapse. That doesn&#8217;t mean cash, it means providing the certainty to\u00a0 enable us to deliver festivals, guidance on safety, and an understanding of how their timing affects\u00a0 us in the real world.<\/p>\n<p>\u201cAt the end of this week, WOMAD will be faced with one very difficult and heart-wrenching decision.\u00a0 Millions of pounds of investment and the livelihood of around five thousand people are at stake.\u00a0 Several pilot events have been successfully run over recent months. But, like other festival teams,\u00a0 we need to be told what that research means for WOMAD.
