{"id":216520,"date":"2024-11-13T10:44:06","date_gmt":"2024-11-13T10:44:06","guid":{"rendered":"https:\/\/www.musicbusinessworldwide.com\/?p=216520"},"modified":"2024-11-13T11:41:09","modified_gmt":"2024-11-13T11:41:09","slug":"openai-sued-by-gema-in-germany-for-unlicensed-use-of-song-lyrics","status":"publish","type":"post","link":"https:\/\/www.musicbusinessworldwide.com\/openai-sued-by-gema-in-germany-for-unlicensed-use-of-song-lyrics\/","title":{"rendered":"ChatGPT maker OpenAI, valued at $157bn, sued by GEMA in Germany over unlicensed use of song lyrics"},"content":{"rendered":"<p>OpenAI, the <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2024-10-02\/openai-has-closed-new-funding-round-raising-over-6-5-billion\" target=\"_blank\" rel=\"noopener\">$157 billion-valued <\/a>US-based AI giant behind ChatGPT, has been sued by German collection society and licensing body GEMA.<\/p>\n<p>GEMA alleges that OpenAI, via its ChatGPT chatbot, &#8220;reproduce[es] protected song lyrics by German authors without having acquired licenses or paid the authors in question&#8221;.<\/p>\n<p>According to the organization, the lawsuit aims &#8220;to prove that OpenAI systematically uses GEMA&#8217;s repertoire to train its systems.&#8221;<\/p>\n<p>GEMA represents the copyrights of around <strong>95,000<\/strong> members in Germany (composers, lyricists, music publishers) as well as over <strong>two million<\/strong> rightsholders worldwide.<\/p>\n<p>The lawsuit marks the latest major lawsuit filed against an AI company over the alleged unlicensed reproduction of song lyrics via a chatbot.<\/p>\n<p><a class=\"link-internal\" href=\"https:\/\/www.musicbusinessworldwide.com\/ai-company-anthropic-amazon-sued-universal-music-group\/\" target=\"_blank\" rel=\"noopener\">Last fall<\/a>, <strong>Universal Music Publishing Group<\/strong>,\u00a0<strong><a class=\"link-relationship\" style=\"box-sizing: border-box; and that in 2024, &#8220;the company is aiming for sales of up to $5 billion&#8221;.<\/p>\n<p>But it claims, however, that OpenAI&#8217;s ChatGPT &#8220;was trained with copyrighted texts, including song lyrics from the repertoire of around 95,000 GEMA members&#8221; who have &#8220;not yet been paid for the use of their works&#8221;.<\/p>\n<p class=\"p2\">      <div class=\"mb-advert__incontent\">      <div class=\"mb-advert mb-advert__spu\" data-loaded=\"no\" data-name=\"300x250 Sponsor MPU #1\" data-params=\"dfp_spu1\" id=\"dfp_spu1\"><\/div>      <\/div>      <\/p>\n<p>GEMA filed the lawsuit with the Munich Regional Court on Wednesday against US parent company OpenAI, LLC and OpenAI Ireland Ltd., the company&#8217;s operator in Europe.<\/p>\n<p>The lawsuit claims that &#8220;when simple prompts are entered, [ChatGPT] reproduces the original song lyrics with which the system has obviously been trained&#8221;.<\/p>\n<p>GEMA said on Wednesday that &#8220;while other internet services pay licensing fees to authors for using their texts, OpenAI systematically makes use of the authors&#8217; content, deliberately infringing copyrights&#8221; and that &#8220;fair remuneration is circumvented&#8221;.<\/p>\n<p class=\"p1\">      <div class=\"mb-advert__incontent\">      <div class=\"mb-advert mb-advert__spu\" data-loaded=\"no\" data-name=\"300x250 Sponsor MPU #2\" data-params=\"dfp_spu2\" id=\"dfp_spu2\"><\/div>      <\/div>      <\/p>\n<p>GEMA&#8217;s lawsuit claims that numerous well-known German music artists, including Kristina Bach (&#8220;Atemlos&#8221;), Rolf Zuckowski, Reinhard Mey, Inga Humpe, Thomas Eckert, Ulf Sommer and Peter Plate, as well as their music publishers, support GEMA&#8217;s lawsuit.<\/p>\n<p>The collection society alleges that their &#8220;song lyrics have demonstrably been exploited by the chatbot without remuneration&#8221;.<\/p>\n<p>The lawsuit arrived just over a month after GEMA <a href=\"https:\/\/www.musicbusinessworldwide.com\/gema-proposes-licensing-model-for-ai-generated-music\/\" target=\"_blank\" rel=\"noopener\">proposed<\/a>\u00a0a generative AI licensing model.<\/p>\n<p>Last week, GEMA <a href=\"https:\/\/www.musicbusinessworldwide.com\/germanys-gema-launches-ai-charter-laying-out-legal-and-ethical-principles-for-artificial-intelligence-in-music\/\" target=\"_blank\" rel=\"noopener\">launched<\/a> an &#8216;AI Charter&#8217; However, it also shows that we are prepared to enforce the rights to which authors are entitled.&#8221;<\/p>\n<hr \/>\n<p>Other AI companies that face legal action for using music without permission include AI music generators Suno and Udio.<\/p>\n<p>In June, the controversial startups were <a class=\"link-internal\" href=\"https:\/\/www.musicbusinessworldwide.com\/major-record-companies-sue-ai-music-generators-suno-udio-for-mass-infringement-of-copyright\/\" target=\"_blank\" rel=\"noopener\">sued by the major record companies<\/a>\u00a0for allegedly training their systems using the majors\u2019 recordings without permission.<\/p>\n<p>Both companies have<a class=\"link-internal\" href=\"https:\/\/www.musicbusinessworldwide.com\/as-suno-and-udio-admit-training-ai-with-unlicensed-music-record-industry-says-theres-nothing-fair-about-stealing-an-artists-lifes-work\/\">\u00a0as much as admitted<\/a>\u00a0via court filings that they used copyrighted recordings from the companies that sued them.<\/p>\n<hr \/>\n<p>Separately, OpenAI <a href=\"https:\/\/www.musicbusinessworldwide.com\/openai-just-won-a-copyright-battle-brought-by-two-news-outlets-what-could-this-mean-for-the-music-industrys-lawsuits-against-ai-firms\/\" target=\"_blank\" rel=\"noopener\">recently won<\/a> a copyright battle brought by two news outlets.
