The UK is falling behind.\u201d<\/p>\n<p>That has drawn criticism from some observers, who fear that AI-friendly copyright reforms could undermine the value of intellectual property.<\/p>\n<p>\u201cThe recommendation to reform copyright law to favor AI companies is terrible news for the creative industries,\u201d said <strong>Ed Newton-Rex<\/strong>, founder and CEO of <strong>Fairly Trained<\/strong>, in a <a href=\"https:\/\/www.linkedin.com\/posts\/ed-newton-rex_i-agree-with-a-lot-of-what-matt-clifford-activity-7284571766125948930-7VcW\/\" target=\"_blank\" rel=\"noopener\">post<\/a> on LinkedIn.<\/p>\n<blockquote><figure class=\"mbw-articlepic mbw-articlepic--right\"><img  alt=\"Ed Newton Rex\" title=\"Ed Newton Rex\" class=\"lazyload\" data-srcset=\"https:\/\/www.musicbusinessworldwide.com\/files\/2024\/01\/ed-newton-rex-80x44.jpg 80w, https:\/\/www.musicbusinessworldwide.com\/files\/2024\/01\/ed-newton-rex-160x88.jpg 160w, https:\/\/www.musicbusinessworldwide.com\/files\/2024\/01\/ed-newton-rex-320x175.jpg 320w, https:\/\/www.musicbusinessworldwide.com\/files\/2024\/01\/ed-newton-rex-418x229.jpg 418w, https:\/\/www.musicbusinessworldwide.com\/files\/2024\/01\/ed-newton-rex-648x355.jpg 648w, https:\/\/www.musicbusinessworldwide.com\/files\/2024\/01\/ed-newton-rex-836x458.jpg 836w, https:\/\/www.musicbusinessworldwide.com\/files\/2024\/01\/ed-newton-rex-1296x710.jpg 1296w\" data-sizes=\"auto\"><\/figure><p>\u201cThe recommendation to reform copyright law to favor AI companies is terrible news for the creative industries.&#8221;<\/p>\n<p><span style=\"color: #000000;\">Ed Newton-Rex, Fairly Trained<\/span><\/p><\/blockquote>\n<p><a href=\"https:\/\/www.musicbusinessworldwide.com\/ed-newton-rex-launches-certification-for-ai-models-respect-copyrights\/\" target=\"_blank\" rel=\"noopener\">Fairly Trained<\/a> is a non-profit that certifies AI models that have been trained ethically (i.e., without the unauthorized use of copyrighted content).<\/p>\n<p>\u201cWe could get all the benefits of the Action Plan, and be a leader in AI, without upending copyright law,\u201d added Newton-Rex, who in 2023 <a href=\"https:\/\/www.musicbusinessworldwide.com\/why-just-resigned-from-my-job-generative-ai\/\" target=\"_blank\" rel=\"noopener\">resigned<\/a> as VP of Audio at <strong>Stability AI<\/strong> over the company\u2019s insistence that using copyrighted materials without permission to train AI amounts to \u201cfair use\u201d under US copyright law.<\/p>\n<p><strong>Dan Conway<\/strong>, CEO of the <strong>Publishers Association<\/strong>, which represents book and periodical publishers, warned that this reform could lead to \u201ca US tech-led heist of UK copyrighted works.\u201d<\/p>\n<p><span style=\"font-weight: 400;\">      <div class=\"mb-advert__incontent\">      <div class=\"mb-advert mb-advert__spu\" data-loaded=\"no\" data-name=\"300x250 Sponsor MPU #1\" data-params=\"dfp_spu1\" id=\"dfp_spu1\"><\/div>      <\/div>      <\/span><\/p>\n<p>In <a href=\"https:\/\/www.linkedin.com\/posts\/the-publishers-association_a-response-the-ai-opportunities-action-plan-activity-7284539266825633793-moMb?utm_source=share&amp;utm_medium=member_android\" target=\"_blank\" rel=\"noopener\">a LinkedIn post<\/a> on Monday, Conway noted Parliament is currently running a consultation on AI and copyright, and said the Publishers Association \u201cwill be seeking assurances from Ministers that all options \u2013 including enforcing the existing gold standard copyright regime with transparency provisions \u2013 remain under full consideration and proper scrutiny.\u201d<\/p>\n<p>At this point, the details of how the UK plans to reform its copyright laws are unknown, but the reference to the European Union offers some guidance.<\/p>\n<p>The EU\u2019s <a href=\"https:\/\/www.musicbusinessworldwide.com\/as-landmark-ai-act-passes-eu-parliament-vote-rightsholders-urge-meaningful-and-effective-enforcement-of-copyright\/\" target=\"_blank\" rel=\"noopener\">AI Act<\/a>, which Brussels has promoted as the world\u2019s first comprehensive law governing artificial intelligence, creates an \u201copt-out\u201d regime for AI data mining. AI developers can scrape the internet for copyrighted materials to train their models, unless a copyright holder expressly states that they object.<\/p>\n<blockquote><p>&#8220;The UK can achieve public service reform and seize all the growth opportunities associated with AI without facilitating a US tech-led heist of UK copyrighted works.&#8221;<\/p>\n<p><span style=\"color: #000000;\">Dan Conway, Publishers Association<\/span><\/p><\/blockquote>\n<p>That model has irritated many music rights holders, who are pushing for an \u201copt-in\u201d model, under which AI developers can\u2019t use copyrighted content to train AI unless they get permission from rights holders. They argue that the opt-out model unfairly puts the onus on copyright owners to enforce their rights.<\/p>\n<p>Nonetheless, some music majors took advantage of the EU law to clarify that they don\u2019t consent to their copyrighted works being used for AI without prior authorization.<\/p>\n<p>In May of last year, <strong>Sony Music Group<\/strong> <a href=\"https:\/\/www.musicbusinessworldwide.com\/sony-music-sends-letters-to-700-ai-music-streaming-companies-declaring-its-opting-out-of-ai-training1\/\" target=\"_blank\" rel=\"noopener\">sent a letter<\/a> to 700 AI developers and music streaming services declaring it\u2019s opting out of having its materials used to train AI. A month later, <strong>Warner Music Group<\/strong> sent a letter to tech companies notifying them they <a href=\"https:\/\/www.musicbusinessworldwide.com\/warner-music-group-ai-developers-they-need-permission-to-use-its-content1\/\" target=\"_blank\" rel=\"noopener\">need permission to use its content<\/a>.<\/p>\n<p>Another point in the proposed AI plan aims to create a \u201ccopyright-cleared\u201d library of media content for AI developers. According to the Action Plan, the so-called \u201cBritish media asset training data set\u201d would potentially be sourced from institutions such as the National Archives, the Natural History Museum, the British Library, and the BBC.<\/p>\n<p><span style=\"font-weight: 400;\">      <div class=\"mb-advert__incontent\">      <div class=\"mb-advert mb-advert__spu\" data-loaded=\"no\" data-name=\"300x250 Sponsor MPU #2\" data-params=\"dfp_spu2\" id=\"dfp_spu2\"><\/div>      <\/div>      <\/span><\/p>\n<p>The UK\u2019s AI plan comes amid growing competition among nations for a key role in the development of artificial intelligence, and ongoing disputes between rights holders and tech companies over the use of copyrighted works to train AI models.<\/p>\n<p>In the US, copyright owners have filed numerous lawsuits against AI developers, alleging that the tech companies used copyrighted materials without permission to train their AI.<\/p>\n<p>Among the most prominent of these are <a href=\"https:\/\/www.musicbusinessworldwide.com\/major-record-companies-sue-ai-music-generators-suno-udio-for-mass-infringement-of-copyright\/\" target=\"_blank\" rel=\"noopener\">two lawsuits<\/a> filed by divisions of <strong>Sony Music Group<\/strong>, <strong>Universal Music Group<\/strong>, and <strong>Warner Music Group<\/strong> against <strong>Suno<\/strong> and <strong>Udio<\/strong>, generative AI services that enable users to create entire songs from text prompts quickly.<\/p>\n<p>The music majors allege Suno and Udio trained their models on their works, pointing to similarities between existing copyrighted songs and content created by the AI music-making platforms.<\/p>\n<p>For their part, Suno and Udio have <a href=\"https:\/\/www.musicbusinessworldwide.com\/as-suno-and-udio-admit-training-ai-with-unlicensed-music-record-industry-says-theres-nothing-fair-about-stealing-an-artists-lifes-work\/\" target=\"_blank\" rel=\"noopener\">all but admitted<\/a> that they likely used copyrighted material, but argue that this falls under \u201cfair use.\u201d<\/p>\n<p>AI firm Anthropic is <a href=\"https:\/\/www.musicbusinessworldwide.com\/anthropic-asks-court-to-prune-universal-lawsuit-to-focus-court-battle-on-whether-it-is-fair-use-to-train-ai-using-copyrighted-works\/\" target=\"_blank\" rel=\"noopener\">using a similar argument<\/a> to defend itself against a lawsuit by <strong>UMG<\/strong>, <strong>Concord<\/strong>, and <strong>ABKCO<\/strong> alleging that Anthropic\u2019s Claude chatbot ripped off copyrighted lyrics.<\/p>\n<hr \/>\n<p>The UK\u2019s AI Action Plan focuses on the potential economic benefits of developing AI and the potential efficiencies that AI can bring to government services.<\/p>\n<p>Citing data from the IMF, the UK government estimates that if AI were fully developed, it would add <strong>GBP \u00a347 billion<\/strong> (<strong>USD $57.1 billion<\/strong>) to the US economy annually within 10 years.<\/p>\n<p>The plan comes with a commitment from several tech companies to invest a combined <strong>\u00a314 billion<\/strong> (<strong>$17 billion<\/strong>) into developing AI in the UK, creating some <strong>13,250<\/strong> jobs in the process.<\/p>\n<p>It also comes with a plan to create new \u201cAI Growth Zones\u201d where proposals to develop AI infrastructure will be fast-tracked. The first of these zones will be in Culham, Oxfordshire, home to the UK\u2019s Atomic Energy Authority.<\/p>\n<p>\u201cArtificial Intelligence will drive incredible change in our country. From teachers personalizing lessons, to supporting small businesses with their record-keeping, to speeding up planning applications, it has the potential to transform the lives of working people,\u201d Prime Minister <strong>Sir Keir Starmer<\/strong> said in a statement.<\/p>\n<p>\u201cBut the AI industry needs a government that is on their side, one that won\u2019t sit back and let opportunities slip through its fingers. And in a world of fierce competition, we cannot stand by.
