{"id":230583,"date":"2025-05-02T14:53:42","date_gmt":"2025-05-02T13:53:42","guid":{"rendered":"https:\/\/www.musicbusinessworldwide.com\/?p=230583"},"modified":"2025-05-02T15:03:19","modified_gmt":"2025-05-02T14:03:19","slug":"warner-music-sues-retail-giant-designer-shoe-warehouse-for-allegedly-infringing-200-works-in-tiktok-posts","status":"publish","type":"post","link":"https:\/\/www.musicbusinessworldwide.com\/warner-music-sues-retail-giant-designer-shoe-warehouse-for-allegedly-infringing-200-works-in-tiktok-posts\/","title":{"rendered":"Warner Music sues retail giant DSW Designer Shoe Warehouse over infringement of 200+ works in TikTok and Instagram posts"},"content":{"rendered":"<p>There&#8217;s a rising trend of prominent businesses being sued for using music in TikTok and Instagram posts without permission.<\/p>\n<p>Just last week, Warner Music Group <a href=\"https:\/\/www.musicbusinessworldwide.com\/cookie-giant-crumbl-reportedly-eyeing-2bn-sale-sued-by-warner-music-group-over-massive-copyright-infringement-in-tiktok-posts\/\" target=\"_blank\" rel=\"noopener\">sued<\/a> Cookie giant Crumbl over what it alleged was &#8220;massive scale&#8221; copyright infringement in TikTok posts.<\/p>\n<p>The case follows similar lawsuits from the other major music companies over music usage in social posts, such as Sony Music&#8217;s <a href=\"https:\/\/www.musicbusinessworldwide.com\/sony-music-sues-university-of-southern-california-over-music-used-in-social-media-posts\/\" target=\"_blank\" rel=\"noopener\">lawsuit<\/a> against the <b>University of Southern California and <\/b>UMG&#8217;s <a href=\"https:\/\/www.musicbusinessworldwide.com\/universal-sues-chilis-restaurant-chain-owner-over-alleged-copyright-infringement-in-social-media-ads\/\" target=\"_blank\" rel=\"noopener\">lawsuit<\/a> against the owner of US Tex-Mex restaurant chain <b>Chili\u2019s<\/b>.<\/p>\n<p>Now, Warner Music Group has filed a copyright infringement lawsuit against US shoe retailer <strong>DSW<\/strong> <strong>Designer Shoe Warehouse<\/strong> and parent company <strong>Designer Brands Inc,<\/strong>\u00a0accusing DSW of having &#8220;misappropriated over <strong>two hundred<\/strong>&#8221; of Warner&#8217;s recordings and compositions in TikTok and Instagram posts and via paid partnerships with social media influencers.<\/p>\n<p>Warner is seeking\u00a0statutory damages up to the maximum amount of <strong>$150,000<\/strong> per infringed musical work. With DSW alleged to have infringed over 200 tracks, the damages sought could exceed $30 million.<\/p>\n<p class=\"p1\">      <div class=\"mb-advert__incontent\">      <div class=\"mb-advert mb-advert__tweeny hidden-xs hidden-ms hidden-sm\" data-loaded=\"no\" data-sizes=\"992 1200 1440\" data-name=\"628x90 Sponsor banner #5 (992+1200+1440)\" data-params=\"dfp_sponsor5_628\" id=\"dfp_sponsor5_628\"><\/div>      <div class=\"mb-advert mb-advert__banner mb-advert__banner--inline hidden-xs hidden-sm hidden-md hidden-lg\" data-loaded=\"no\" data-sizes=\"480\" data-name=\"468x60 Sponsor banner #5 (480)\" data-params=\"dfp_sponsor5_468\" id=\"dfp_sponsor5_468\"><\/div>      <div class=\"mb-advert mb-advert__mobile mb-advert__mobile--inline hidden-ms hidden-md hidden-lg\" data-loaded=\"no\" data-sizes=\"320 768\" data-name=\"300x50 Sponsor banner #5 (320+768)\" data-params=\"dfp_sponsor5_300\" id=\"dfp_sponsor5_300\"><\/div>      <\/div>      <\/p>\n<p>DSW is described in the lawsuit as &#8220;one of North America\u2019s largest designers, producers and retailers of footwear and accessories&#8221;.<\/p>\n<p>The company was founded in 1969.<\/p>\n<p>Warner&#8217;s complaint notes that &#8220;during its 55-year history, DSW has repeatedly licensed music for promoting its brand and products in television commercials&#8221; and that DSW has also &#8220;licensed music for its commercials from WMG in the past&#8221;.<\/p>\n<p>According to the lawsuit, filed in Ohio on Thursday (May 1), DSW allegedly infringed <strong>200+<\/strong> &#8220;popular and valuable musical works&#8221; in social media posts by &#8220;using these musical works to attract attention to the DSW Videos, drive sales to DSW, and build DSW\u2019s brand awareness and profile&#8221;.<\/p>\n      <div class=\"mb-advert__incontent\">      <div class=\"mb-advert mb-advert__spu\" data-loaded=\"no\" data-name=\"300x250 Sponsor MPU #1\" data-params=\"dfp_spu1\" id=\"dfp_spu1\"><\/div>      <\/div>      \n<p>Among the works alleged to have been infringed by DSW are what WMG calls &#8220;some of the most popular sound recordings and musical compositions in the world&#8221;.<\/p>\n<p>Warner claims that DSW used tracks such as <em>Up<\/em> by Cardi B, <em>Dreams<\/em> by Fleetwood Mac, <em>About Damn Time<\/em> by Lizzo, <em>Hung Up<\/em> by Madonna, and <em>Work it<\/em> by Missy Elliot in social media posts without a license.<\/p>\n<p>&#8220;&#8216;DSW not only failed to pay for the use of Plaintiffs\u2019 Works, but by including these musical works in their promotional materials without Plaintiffs\u2019 consent, DSW deprived Plaintiffs and the recording artists and songwriters that Plaintiffs represent of the ability to control how and where their musical works are used,&#8221; the lawsuit stated.<\/p>\n<p class=\"p1\">      <div class=\"mb-advert__incontent\">      <div class=\"mb-advert mb-advert__spu\" data-loaded=\"no\" data-name=\"300x250 Sponsor MPU #2\" data-params=\"dfp_spu2\" id=\"dfp_spu2\"><\/div>      <\/div>      <\/p>\n<p>According to the lawsuit, which you can <a href=\"https:\/\/www.musicbusinessworldwide.com\/files\/2025\/05\/ECF-001-COMPLAINT-with-Schedule-A-1.pdf\">read in full here<\/a>,\u00a0 &#8220;over recent years, DSW, like many retailers, has shifted much of its marketing focus from traditional advertising to promoting its products through social media platforms such as Instagram and TikTok, as well as via paid partnerships with well-known social media &#8216;influencers&#8217;.&#8221;<\/p>\n<p>The lawsuit continues: &#8220;Broadly speaking, an &#8216;influencer&#8217; is a person with a large social media following whose reputation and credibility enables them to influence consumers\u2019 purchasing decisions or brand awareness.<\/p>\n<p>&#8220;Knowing that popular music is the best way to capture the attention of its targeted audience, DSW and its social media influencers have incorporated many of Plaintiffs\u2019 most valuable musical works into marketing and advertising videos for DSW\u2019s products.<\/p>\n<p>&#8220;These videos &#8230; are an integral part of DSW\u2019s promotional, marketing, and branding strategy. DSW distributes the DSW Videos to the public via the various accounts that it maintains on a variety of social media platforms.&#8221;<\/p>\n<p>Warner&#8217;s complaint argues that even though DSW &#8220;is a sophisticated party that has extensive experience with music licensing,&#8221; the company &#8220;and its influencer partners have failed to seek permission or pay for the use of the sound recordings and musical compositions that are featured in the DSW Videos&#8221;.<\/p>\n<hr \/>\n<p>The lawsuit is the latest involving a prominent music company taking legal action over unauthorized use of music in social media posts.<\/p>\n<p class=\"p1\">Energy drink company<b> Bang Energy<\/b> was sued in 2022, with both <b>Universal Music Group <\/b>and<b> Sony Music Entertainment <\/b>winning judgments for similar copyright infringement claims involving unauthorized use of music in social media marketing. Warner also <a href=\"https:\/\/www.musicbusinessworldwide.com\/warner-sues-bang-energy-for-alleged-infringement-of-nearly-200-songs-by-artists-including-dua-lipa-lizzo-and-others12\/\" target=\"_blank\" rel=\"noopener\">sued<\/a> Bang Energy in September 2022 after Sony Music <a href=\"https:\/\/www.musicbusinessworldwide.com\/sony-music-scores-partial-victory-in-copyright-infringement-lawsuit-against-bang-energy1234\/\" target=\"_blank\" rel=\"noopener\">scored partial victory<\/a> in its own case.<\/p>\n<p class=\"p1\">The unauthorized use of copyrighted music and sound recordings on social media marketing have prompted major music companies to lodge legal actions in recent months.
