{"id":233870,"date":"2025-06-12T12:23:32","date_gmt":"2025-06-12T11:23:32","guid":{"rendered":"https:\/\/www.musicbusinessworldwide.com\/?p=233870"},"modified":"2025-06-12T23:36:57","modified_gmt":"2025-06-12T22:36:57","slug":"nmpa-says-spotify-bundling-move-could-cost-music-publishers-3-1bn-through-2032","status":"publish","type":"post","link":"https:\/\/www.musicbusinessworldwide.com\/nmpa-says-spotify-bundling-move-could-cost-music-publishers-3-1bn-through-2032\/","title":{"rendered":"NMPA says Spotify &#8216;bundling&#8217; move could cost music publishers $3.1bn through 2032"},"content":{"rendered":"<p class=\"p1\">The National Music Publishers&#8217; Association projects that music publishers will &#8220;lose over $3.1 billion&#8221; through 2032 due to Spotify&#8217;s audiobook \u201cbundling practices\u201d.<\/p>\n<p class=\"p1\">That&#8217;s according to Executive Vice President and General Counsel <b>Danielle Aguirre, who, speaking at the <a href=\"https:\/\/www.youtube.com\/watch?v=ZYHnsbpRtoM&amp;t=73s&amp;ab_channel=NMPAorg\" target=\"_blank\" rel=\"noopener\">NMPA\u2019s 2025 Annual Meeting<\/a> in New York on Wednesday (June 11), <\/b>detailed how <b>Spotify<\/b>&#8216;s decision to reclassify its premium music service as a bundled offering in March 2024 has, &#8220;by Spotify&#8217;s own numbers&#8221; resulted in a <b>$230 million<\/b> loss for publishers during its first year of implementation.<\/p>\n<p><b>Aguirre added that &#8220;<\/b>these losses will continue if we can&#8217;t reverse or correct Spotify&#8217;s actions. One of the biggest challenges continues to come from Spotify&#8217;s mischaracterization of its music service into bundles, which forced the conversion of over 44 million subscribers into bundle platforms that those subscribers did not request.<\/p>\n<p class=\"p1\">\u201cThis negatively impacted mechanical royalty payments by attempting to exploit a loophole in the<b> Section 115 <\/b>regulations.\u201d<\/p>\n<p class=\"p1\">The \u2018Section 115\u2019 rules cited by Aguirre refer to the compulsory license in the US,<a href=\"https:\/\/www.copyright.gov\/circs\/circ73.pdf\" target=\"_blank\" rel=\"noopener\"> also known as the 115 License<\/a> (because it is stipulated under section 115 of the <b>Copyright Act<\/b>), which allows eligible digital services to use copyrighted music for a set fee without having to negotiate directly with rightsholders.<\/p>\n<p class=\"p1\">In March 2024, Spotify <a href=\"https:\/\/www.musicbusinessworldwide.com\/spotify-estimates-that-it-would-have-to-pay-out-50m-if-the-mlc-wins-its-bundling-lawsuit\/\" target=\"_blank\" rel=\"noopener\">reclassified<\/a> its Premium subscription tiers as \u201cbundles,\u201d as they now include<a href=\"https:\/\/www.musicbusinessworldwide.com\/spotify-unveils-standalone-audiobooks-tier-for-free-users-priced-at-9-99-month\/\" target=\"_blank\" rel=\"noopener\"> 15 hours of audiobook access <\/a>each month.<\/p>\n<p class=\"p1\">The reclassification is significant because under a<a href=\"https:\/\/www.musicbusinessworldwide.com\/can-you-feel-the-love-tonight-spotify-and-fellow-music-streamers-strike-agreement-with-publishers-for-15-35\/\" target=\"_blank\" rel=\"noopener\"> 2022 legal settlement called <b>Phonorecords IV<\/b><\/a>, music publishers and music streaming services agreed that \u2018bundle\u2019 services in the United States are permitted to pay a lower mechanical royalty rate to publishers and songwriters than standalone music subscription services.<\/p>\n<hr \/>\n<div class=\"mb-embed-container\"><iframe src=\"https:\/\/www.youtube.com\/embed\/ZYHnsbpRtoM?si=b4urdstti-tXeV5_\" frameborder=\"0\" allowfullscreen><\/iframe><\/div>\n<hr \/>\n<p>\u2018Phonorecords IV\u2019 set the on-demand streaming mechanical rates in the US for the five years between <strong>2023 and 2027.<\/strong><\/p>\n<p>Under the CRB IV or <strong>Phonorecords IV<\/strong>, songwriters and music publishers are <a href=\"https:\/\/www.musicbusinessworldwide.com\/crb-officially-accepts-settlement-that-will-see-songwriters-paid-more-in-the-us-over-the-next-5-years\/\" target=\"_blank\" rel=\"noopener\">paid a headline rate of<b> 15.35%<\/b><\/a> of a given interactive streaming service\u2019s US revenue from 2023 through 2027.<\/p>\n<p class=\"p1\">      <div class=\"mb-advert__incontent\">      <div class=\"mb-advert mb-advert__spu\" data-loaded=\"no\" data-name=\"300x250 Sponsor MPU #2\" data-params=\"dfp_spu2\" id=\"dfp_spu2\"><\/div>      <\/div>      <\/p>\n<p>Elsewhere during her presentation, Aguirre revealed a stat related to Spotify rival <strong>Amazon Music&#8217;s <\/strong><a href=\"https:\/\/www.musicbusinessworldwide.com\/amazon-music-to-bundle-audiobooks-from-audible-and-unlike-spotifys-bundling-move-publishers-say-it-wont-decrease-revenue-for-songwriters\/\" target=\"_blank\" rel=\"noopener\">decision in November<\/a>\u00a0to bundle <strong>audiobooks<\/strong>\u00a0with its Premium subscription.<\/p>\n<p>The exec told the audience: \u201cLast year, [the NMPA] warned that if left unchecked, other services will try the same tactics as Spotify. And that has now happened. Amazon recently followed suit and has forcibly converted their music subscribers into similar bundled plans.\u201d<\/p>\n<p class=\"p1\">According to Aguirre, Amazon &#8220;recently followed suit and has forcibly converted their music subscribers into a similar bundled plan&#8221;.<\/p>\n<p class=\"p1\">Aguirre reports that &#8220;in just the last three months, we&#8217;ve seen a <strong>40%<\/strong> decrease in music revenue from Amazon&#8221;. Aguirre says Amazon\u2019s latest action \u201chas hit the PROs particularly hard.\u201d<\/p>\n<p class=\"p1\">Aguirre&#8217;s statement contrasted that of NMPA President &amp; CEO<b> David Israelite<\/b>, who said in November 2024 \u2014 right after Amazon started bundling its music streaming service with audiobooks \u2014 that the NMPA is \u201coptimistic about the new Amazon bundle\u201d.<\/p>\n<p class=\"p1\">At the time, Israelite said: \u201cAmazon has engaged with the music publishing and songwriting industry in a respectful and productive way, unlike Spotify.<\/p>\n<p class=\"p1\">\u201cWe expect this new Amazon bundle will not decrease revenue for songwriters.
