Suno and Udio have been slapped with another round of copyright litigation, this time by country musician Tony Justice, who filed class-action lawsuits against both controversial AI music generators.<\/p>\n
The complaints allege Suno<\/b> and Udio<\/b> used Justice\u2019s recordings and works from \u201cthousands of class members\u201d without authorization to train their AI models.<\/p>\n
Justice and his label, 5th Wheel Records<\/b>, filed the lawsuit against Suno (which you can read here<\/a>) in Massachusetts, and the case against Udio (read here<\/a>) in New York.<\/p>\n The 23- and 24-page lawsuits argue that while major labels pursue their own infringement cases, independent artists “whose rights have been trampled the most” remain excluded from \u201cthe table, unrepresented, and without a meaningful remedy.\u201d<\/p>\n In June last year, the major music companies\u00a0sued<\/a> the AI startups in the US for allegedly training their systems using the companies\u2019 recordings without permission \u2013 an accusation they pretty much admitted<\/a>\u00a0to in court filings last August.<\/p>\n Most recently, Justice\u2019s complaint states: \u201cRather than simply license these copyrighted songs like every other tech-based business does, Suno\/Udio elected to simply steal the songs and generate AI-soundalike music at virtually no cost to Suno\/Udio.\u201d<\/p>\n \u201cRather than simply license these copyrighted songs like every other tech-based business does, Suno\/Udio elected to simply steal the songs.”<\/p>\n Tony Justice’s lawsuit<\/span><\/p><\/blockquote>\n Justice\u2019s legal team includes Krystle Delgado<\/b>, an attorney who also performs<\/a> as a musician.<\/p>\n As with the lawsuits filed by the three majors, the new cases challenge the AI companies\u2019 argument that training models on copyrighted material constitutes fair use under copyright law.<\/p>\n Justice’s lawsuits contest this position, citing recent guidance from the US Copyright Office<\/b>. It cited the office\u2019s May 2025 report: Copyright and Artificial Intelligence, Part 3: Generative AI Training<\/em><\/a>, which according to the lawsuit, \u201cemphasized that the fair use doctrine does not excuse unauthorized training on expressive works (e.g., music) particularly when those works are used to generate substitutional outputs that may replace the originals in the relevant marketplace.\u201d<\/p>\n “The process in which Suno\u2019s\/Udio\u2019s AI model trains, through the reproduction and copying of existing copyrighted songs, constitutes prima facie copyright infringement.”<\/p>\n Tony Justice’s lawsuit<\/span><\/p><\/blockquote>\n \u201cSuno\/Udio training its AI model on the copyrighted songs of independent artists, Plaintiffs and Class Members, without authorization, to then create competing music in the exact same marketplace, is unlikely fair use, and therefore, is prima facie copyright infringement.\u201d<\/p>\n The Copyright Office report referenced in the lawsuits warns that AI training involves multiple reproduction acts that could constitute infringement.<\/p>\n \u201cMeaning, the process in which Suno\u2019s\/Udio\u2019s AI model trains, through the reproduction and copying of existing copyrighted songs, constitutes prima facie copyright infringement,\u201d according to the lawsuit.<\/p>\n Justice\u2019s website<\/a> describes him as \u201cone of country music\u2019s most talked about independent artists\u201d and a \u201cfull-time truck driver.\u201d His song, Last of the Cowboys<\/i>, has accumulated over 8 million<\/b> streams on Spotify<\/b>, where he has over 54,700<\/b><\/a> monthly listeners.
