His music was created with Suno, says expert report"},"content":{"rendered":"<p>Earlier this week, <em>MBW<\/em> <a href=\"https:\/\/www.musicbusinessworldwide.com\/the-ai-music-problem-on-spotify-and-other-streaming-platforms-is-worse-than-you-think\/\" target=\"_blank\" rel=\"noopener\">reported<\/a> on Aventhis, the outlaw-country \u201cartist\u201d whose AI-generated tracks have garnered over 1 million monthly listeners on Spotify.<\/p>\n<p>Why did <em>MBW<\/em> conclude that <a href=\"https:\/\/open.spotify.com\/artist\/0a97V3mDhGyNg93Dcf9Ahj\" target=\"_blank\" rel=\"noopener\">Aventhis<\/a> is an AI invention?<\/p>\n<p>Because the person credited as writer and producer on the tracks, <strong>David Vieira<\/strong>, appears to have admitted as much in comments on <strong>YouTube<\/strong>.<\/p>\n<p>\u201c[The] voice and image is created with the help of AI. No, not the <strong>INXS<\/strong> hit from the 1980s, but the outlaw-country \u201cartist\u201d that has nearly <strong>700,000<\/strong> monthly listeners on Spotify.<\/p>\n<p>The Devil Inside&#8217;s track <em>Dust and Thunder<\/em> (800,000 streams) was <strong>99.654%<\/strong> created by Suno, according to Uhmbrella\u2019s analysis, while the track <em>Riders of the Midnight Storm<\/em> (no, not <strong>The Doors<\/strong>\u2019 <em>Riders on the Storm<\/em>), with <strong>785,000<\/strong> listens, was <strong>98.567%<\/strong> created by Suno.<\/p>\n<blockquote><p>&#8220;AI music is flooding streaming platforms at scale. Without proper detection or attribution tools, the industry has no visibility, no accountability, and no way to protect real creators.&#8221;<\/p>\n<p><span style=\"color: #000000;\">Drew Lemoine Belardo, Uhmbrella<\/span><\/p><\/blockquote>\n<p>\u201cOur detection system confirms that nearly every track by Aventhis and The Devil Inside was generated using Suno, with some Riffusion influence,\u201d Uhmbrella CEO <strong>Drew Lemoine Belardo<\/strong> told <em>MBW<\/em>.<\/p>\n<p>\u201cThis isn\u2019t a one off; AI music is flooding streaming platforms at scale. Without proper detection or attribution tools, the industry has no visibility, no accountability, and no way to protect real creators. This is why we built Uhmbrella.\u201d<\/p>\n<p>Suno, along with rival Udio, is one of the two AI music platforms that have been <a href=\"https:\/\/www.musicbusinessworldwide.com\/major-record-companies-sue-ai-music-generators-suno-udio-for-mass-infringement-of-copyright\/\" target=\"_blank\" rel=\"noopener\">sued by the recording majors<\/a> for their (alleged) unauthorized use of copyrighted songs to train their AI models \u2013 something they have <a href=\"https:\/\/www.musicbusinessworldwide.com\/as-suno-and-udio-admit-training-ai-with-unlicensed-music-record-industry-says-theres-nothing-fair-about-stealing-an-artists-lifes-work\/\" target=\"_blank\" rel=\"noopener\">all but admitted to<\/a> in court documents, arguing their use of the songs should be seen as \u201cfair use.\u201d<\/p>\n<p><span style=\"font-weight: 400;\">      <div class=\"mb-advert__incontent\">      <div class=\"mb-advert mb-advert__spu\" data-loaded=\"no\" data-name=\"300x250 Sponsor MPU #2\" data-params=\"dfp_spu2\" id=\"dfp_spu2\"><\/div>      <\/div>      <\/span><\/p>\n<p>More recently, a news report suggested that Suno and Udio <a href=\"https:\/\/www.musicbusinessworldwide.com\/universal-warner-and-sony-in-talks-to-license-ai-music-generators-suno-and-udio-report\/\" target=\"_blank\" rel=\"noopener\">are in licensing talks<\/a> with the record companies that are suing them.<\/p>\n<p>Riffusion is a competitor to Suno and Udio that seems to have avoided lawsuits by rights holders so far. However, in the case of Riffusion, concerns have been raised about its terms of service \u2013 which might mean that Vieira (or whoever is actually collecting the income from Aventhis\u2019 music) might one day have their income taken by the AI company.<\/p>\n<hr \/>\n<h6>Concerns over ownership of Riffusion-created music<\/h6>\n<p>According to <a href=\"https:\/\/www.toolify.ai\/ai-news\/riffusion-ai-music-generation-copyright-concerns-legal-analysis-3386900\" target=\"_blank\" rel=\"noopener\">a report by Toolify.ai<\/a>, Riffusion\u2019s terms of service state that the tool can only be used for non-commercial purposes (in which case David Vieira, or whoever is ultimately behind Aventhis, may have violated the TOS). They also state that users of its tools grant the company an irrevocable license to the music created on the platform (in which case Vieira might one day be challenged by Riffusion over Aventhis&#8217; tracks).<\/p>\n<p>More broadly, there\u2019s a question as to whether any rights at all can be claimed on music that has relied so heavily on AI for its creation. <a href=\"https:\/\/www.musicbusinessworldwide.com\/can-ai-generated-content-be-copyrighted-heres-what-a-new-report-from-the-us-copyright-office-says1\/\" target=\"_blank\" rel=\"noopener\">According to<\/a> the US Copyright Office (and <a href=\"https:\/\/www.musicbusinessworldwide.com\/ai-made-works-cant-be-copyrightable-says-us-court-for-now-at-least\/\" target=\"_blank\" rel=\"noopener\">according to<\/a> a US federal court), AI-generated art is not copyrightable.<\/p>\n<p>In a paper released earlier this year, the Copyright Office made it clear that works created with the help of AI can only be copyrighted if there is \u201csufficient\u201d human input into the final product.<\/p>\n<p>Does writing the lyrics and having AI generate everything else \u2013 as seems to be the case with Aventhis \u2013 count as \u201csufficient\u201d human input?
