{"id":235933,"date":"2025-07-09T22:30:45","date_gmt":"2025-07-09T21:30:45","guid":{"rendered":"https:\/\/www.musicbusinessworldwide.com\/?p=235933"},"modified":"2025-07-09T22:32:16","modified_gmt":"2025-07-09T21:32:16","slug":"oak-view-group-ceo-timothy-leiweke-indicted-by-doj-for-alleged-arena-bid-rigging-scheme","status":"publish","type":"post","link":"https:\/\/www.musicbusinessworldwide.com\/oak-view-group-ceo-timothy-leiweke-indicted-by-doj-for-alleged-arena-bid-rigging-scheme\/","title":{"rendered":"Oak View Group CEO Timothy Leiweke indicted by DOJ for alleged arena bid rigging scheme"},"content":{"rendered":"<p>Timothy Leiweke, the Co-Founder and Chief Executive Officer of venue developer Oak View Group (OVG), is being indicted by the Department of Justice for allegedly rigging the bidding process for an arena at the University of Texas.<\/p>\n<p>The DOJ said on Wednesday (July 9) that OVG and rival Legends Hospitality have agreed to pay $15 million and $1.5 million in penalties, respectively, in connection with the conduct alleged in the indictment against Leiweke.<\/p>\n<p class=\"p1\">      <div class=\"mb-advert__incontent\">      <div class=\"mb-advert mb-advert__tweeny hidden-xs hidden-ms hidden-sm\" data-loaded=\"no\" data-sizes=\"992 1200 1440\" data-name=\"628x90 Sponsor banner #5 (992+1200+1440)\" data-params=\"dfp_sponsor5_628\" id=\"dfp_sponsor5_628\"><\/div>      <div class=\"mb-advert mb-advert__banner mb-advert__banner--inline hidden-xs hidden-sm hidden-md hidden-lg\" data-loaded=\"no\" data-sizes=\"480\" data-name=\"468x60 Sponsor banner #5 (480)\" data-params=\"dfp_sponsor5_468\" id=\"dfp_sponsor5_468\"><\/div>      <div class=\"mb-advert mb-advert__mobile mb-advert__mobile--inline hidden-ms hidden-md hidden-lg\" data-loaded=\"no\" data-sizes=\"320 768\" data-name=\"300x50 Sponsor banner #5 (320+768)\" data-params=\"dfp_sponsor5_300\" id=\"dfp_sponsor5_300\"><\/div>      <\/div>      <\/p>\n<p>The indictment, filed in the U.S. District Court for the Western District of Texas, alleges that, from approximately February 2018 through at least June 2024, Leiweke conspired with the Chief Executive Officer of its competitor to rig the bidding for the development, management, and use of a multi-purpose arena.<\/p>\n<p><em>CNBC<\/em> <a href=\"https:\/\/www.cnbc.com\/2025\/07\/09\/doj-leiweke-ut-austin-arena-bid.html\" target=\"_blank\" rel=\"noopener\">reports<\/a> that the venue was the $338 million Moody Center arena at the University of Texas in Austin.<\/p>\n<p>According to the indictment, in September 2017, Leiweke informed colleagues that he had learned another venue-services company was \u201cbidding against us\u201d for the Arena Project and wanted to \u201cfind a way to get [the competitor] some of the business\u201d and \u201cget them to back down.\u201d<\/p>\n<p class=\"p1\">      <div class=\"mb-advert__incontent\">      <div class=\"mb-advert mb-advert__spu\" data-loaded=\"no\" data-name=\"300x250 Sponsor MPU #1\" data-params=\"dfp_spu1\" id=\"dfp_spu1\"><\/div>      <\/div>      <\/p>\n<p>In November 2017, Leiweke allegedly informed others that he was \u201c[m]ore than happy talking to [the competitor] about not bidding and [receiving certain subcontracts]\u201d but had \u201cno interest in working with them if they intend on putting in a bid.\u201d<\/p>\n<p>In February of 2018, Leiweke allegedly reached an agreement with the competitor\u2019s CEO, &#8220;pursuant to which the competitor agreed that it would stand down and neither submit nor join an independent competing bid for the Arena Project&#8221;.<\/p>\n<blockquote><p>&#8220;Mr. Leiweke has done nothing wrong and will vigorously defend himself and his well-deserved reputation for fairness and integrity.\u201d<\/p>\n<p><span style=\"color: #000000;\">Spokesperson for Timothy Leiweke<\/span><\/p><\/blockquote>\n<p>In exchange for the competitor\u2019s agreement to stand down, Leiweke allegedly agreed that the rival firm would receive subcontracts for the arena project.<\/p>\n<p>According to the DOJ, &#8220;consistent with the bid-rigging agreement, the competitor did not submit a competing bid for the Arena Project,&#8221; with OVG ultimately submitting &#8220;the sole qualified bid and won the Arena Project&#8221;.<\/p>\n<p>The arena opened to the public in April 2022, and, according to the DOJ, &#8220;OVG continues to receive significant revenues from the project to date&#8221;.<\/p>\n<p class=\"p2\">      <div class=\"mb-advert__incontent\">      <div class=\"mb-advert mb-advert__spu\" data-loaded=\"no\" data-name=\"300x250 Sponsor MPU #2\" data-params=\"dfp_spu2\" id=\"dfp_spu2\"><\/div>      <\/div>      <\/p>\n<p>CNBC cites a spokesperson for Leiweke as saying that the exec &#8220;has done nothing wrong and will vigorously defend himself and his well-deserved reputation for fairness and integrity&#8221;.<\/p>\n<p>The spokesperson added: \u201cThese allegations blatantly ignore established legal precedent and seek to criminalize common teaming efforts that are proven to enhance competition and benefit the public. The Moody Center is a perfect example, as it has resulted in substantial and sustained benefits to the University of Texas and the City of Austin.\u201d<\/p>\n<p>CNBC also <a href=\"https:\/\/www.cnbc.com\/2025\/07\/09\/doj-leiweke-ut-austin-arena-bid.html\" target=\"_blank\" rel=\"noopener\">cited a statement<\/a> from Oak View Group, which reads: \u201cOak View Group cooperated fully with the Antitrust Division\u2019s inquiry and is pleased to have resolved this matter with no charges filed against OVG and no admission of fault or wrongdoing.<\/p>\n<p>\u201cWe support all efforts to ensure a fair and competitive environment in our industry and are committed to upholding industry-leading compliance and disclosure practices.<\/p>\n<p>Leiweke said in a statement issued to CNBC that he has &#8220;decided that now is the right time to implement the succession plan that was already underway and transition out of the CEO role&#8221;.<\/p>\n<blockquote><p>\u201cThe Antitrust Division and its law enforcement partners will continue to hold executives who cheat to avoid competition accountable.\u201d<\/p>\n<p><span style=\"color: #000000;\">Abigail Slater, Assistant Attorney General<\/span><\/p><\/blockquote>\n<p>Assistant Attorney General Abigail Slater of the Justice Department\u2019s Antitrust Division, said: \u201cAs outlined in the indictment, the Defendant rigged a bidding process to benefit his own company and deprived a public university and taxpayers of the benefits of competitive bidding.<\/p>\n<p>\u201cThe Antitrust Division and its law enforcement partners will continue to hold executives who cheat to avoid competition accountable.\u201d<\/p>\n<p>U.S. Attorney Justin R. Raia of the FBI New York Field Office said: \u201cTimothy Leiweke allegedly led a scheme designed to steer the contract for entertainment services at a public university&#8217;s arena to his company. Public contracts are subject to laws requiring an open and competitive bid process to ensure a level playing field.<\/p>\n<p>\u201cThe FBI is determined to ensure that those who disregard fair competition principles do not benefit from a rigged bidding process targeting our communities and public institutions.\u201d<\/p>\n<p>Special Agent in Charge Jonathan R.
