But the investors\u2019 belief there would be a delay reportedly spurred them to sell their shares to a special purpose company backed by HYBE executives.<\/p>\n<p>This company sold its shares after the IPO, and Bang pocketed <strong>30%<\/strong> of the profits, or around <strong>190 billion won<\/strong> (<strong>USD $137 million<\/strong> at the current exchange rate), regulators say. That\u2019s a somewhat lower figure than the <strong>400 billion won<\/strong> that had been <a href=\"https:\/\/www.musicbusinessworldwide.com\/south-korea-financial-watchdog-reportedly-plans-to-refer-hybes-bang-si-hyuk-to-prosecutors-over-alleged-ipo-fraud\/\" target=\"_blank\" rel=\"noopener\">previously reported<\/a>.<\/p>\n<p>According to the <em>Daily<\/em>, private equity funds involved included <strong>STIC Investments<\/strong>, <strong>Estone Equity Partners<\/strong>, and <strong>New Main Equity<\/strong>.<\/p>\n<p><span style=\"font-weight: 400;\">      <div class=\"mb-advert__incontent\">      <div class=\"mb-advert mb-advert__spu\" data-loaded=\"no\" data-name=\"300x250 Sponsor MPU #1\" data-params=\"dfp_spu1\" id=\"dfp_spu1\"><\/div>      <\/div>      <\/span><\/p>\n<p>The <em>Daily<\/em> describes a referral to prosecution as \u201cthe most severe regulatory action that can be taken against individuals for alleged violations of the Capital Markets Act,\u201d but it doesn\u2019t mean that Bang and his associates have been charged with any crimes.<\/p>\n<p>Once a referral has been made, the prosecution service will open its own investigation, and will have the power to indict Bang or dismiss the charges, depending on the available evidence.<\/p>\n<p><span style=\"font-weight: 400;\">      <div class=\"mb-advert__incontent\">      <div class=\"mb-advert mb-advert__spu\" data-loaded=\"no\" data-name=\"300x250 Sponsor MPU #2\" data-params=\"dfp_spu2\" id=\"dfp_spu2\"><\/div>      <\/div>      <\/span><\/p>\n<p>With news reports circulating in recent weeks about a possible referral to prosecution, HYBE issued a statement saying it would cooperate with the investigation, but believed Bang had done nothing wrong.<\/p>\n<p>\u201cWe regret any concern caused by the recent reports related to our IPO process. HYBE is fully cooperating with the local authorities, including the financial regulators and the police, by submitting relevant materials and providing detailed explanations as part of the fact-finding efforts,\u201d the company said in a <a href=\"https:\/\/www.musicbusinessworldwide.com\/hybe-chairman-to-prosecutors-bang\/\" target=\"_blank\" rel=\"noopener\">statement to <em>MBW<\/em><\/a> last week.<\/p>\n<p>\u201cWe will take the necessary time to thoroughly demonstrate that the IPO was carried out in full compliance with laws and regulations.\u201d<\/p>\n<blockquote><p>\u201cWe will take the necessary time to thoroughly demonstrate that the IPO was carried out in full compliance with laws and regulations.\u201d<\/p>\n<p><span style=\"color: #000000;\">HYBE<\/span><\/p><\/blockquote>\n<p>In a statement quoted by the <em>Daily<\/em>, HYBE said \u201cthe majority shareholder fully participated in the investigation and clearly explained that there was no attempt to seek private profit tied to the IPO.
